Julie Jason: Should you do a QCD?

The subject of QCDs is on readers’ minds. As a reminder, a qualified charitable distribution is a way to donate to charity that is available only to IRA owners who are age 70½ (repeat, age 70½) or older. When QCD rules are followed (see my blog at tinyurl.com/mw42ppcf), the withdrawal does not count as income at tax time. That’s a huge benefit to the charitably inclined, especially if they are older and taking RMDs (required minimum distributions).

This is how I think of the decision-making process when considering doing a QCD:

1. Do you want to give to charity?

2. How much?

3. Are your living expenses covered even if you make the gift?

4. What assets could you use to make the gift? That is, what are the possibilities, such as cash, stock, etc., or perhaps an IRA?

5. Do you normally take the standard deduction or itemize?

6. If you normally use the standard deduction, will the size of the gift be sufficient to consider itemizing?

7. Do you have an IRA?

8. Are you over 70½?

9. Are you taking RMDs from your IRA?

10. Do you have a 401(k) or 403(b) or other tax-deferred retirement plan?

11. Do you have an accountant who does your taxes, or do you do them yourself?

With the answers to these questions, you can start to assess charitable gifting possibilities.

Let’s consider “Mort’s” situation. Age 75 and single, Mort wants to give $50,000 to his local hospital’s foundation, and the amount is well within his budget. His potential sources are a bank account; appreciated stock; a tax-free Roth IRA; and a large 401(k). Notice that he does not have a traditional IRA.

Julie Jason: New resources to protect against fraud

I’m sure you’ll agree that we are living in quickly evolving times (just think of the artificial intelligence technology ChatGPT). As investors, the name of the game is to keep learning — not only to make good decisions, but also to avoid fraud.

This theme of “Never Stop Learning” is the centerpiece of a new public service campaign designed by the Securities and Exchange Commission’s Office of Investor Education and Advocacy (OIEA). The effort is focused on helping older investors protect their funds from fraud and abuse.

Protection is needed. Total losses by the elderly due to internet-related fraud increased 84 percent in 2022 from 2021, reaching $3.1 billion for victims over 60 years old, according to the FBI Internet Crime Complaint Center’s Elder Fraud Report 2022 ( tinyurl.com/2p8w78wh). The number of victims topped 88,000, and the average loss per victim was just over $35,000. Nearly 5,500 of the victims lost more than $100,000.

The most common fraud situation involved tech and customer support, with 17,810 victims over the age of 60 and a loss of nearly $588 million. Investment fraud was the costliest for the age group, totaling nearly $1 billion in 2022, a substantial climb from $239 million reported in 2021.

Lifelong income from a QCD?

Did you know that a qualified charitable distribution (QCD) can not only limit your tax liability for a required minimum distribution, but it also can provide a life income plan?

QCDs, which came into existence as part of the Pension Protection Act of 2006, provide a way for IRA owners who are charitably inclined to use part or all of their required minimum distributions (RMDs) — up to $100,000 per year — to avoid being taxed on the RMD when donating to a qualified charity. You can see if a charity qualifies by using the IRS Tax Exempt Organization Search Tool ( tinyurl.com/497um8xp).

Some guidelines: The QCD is considered a nontaxable IRA withdrawal. The IRA owner must be at least 70 ½ years old, which is younger than RMD starting age (currently age 73). The QCD must be paid directly from an IRA to a qualified charity. For more details, see IRS Publication 590-B ( tinyurl.com/yc6tx8dh).

Now, thanks to SECURE Act 2.0, which became law in December 2022 as part of the 2023 Consolidated Appropriations Act, the charity receiving the QCD donation can pay you lifelong income. See “One-time Election for Qualified Charitable Distribution to Split-interest Entity,” Section 307 of SECURE Act 2.0 ( tinyurl.com/ycyck5bs).

A “split-interest entity” is defined in SECURE Act 2.0 as one of three things: a charitable remainder annuity trust, a charitable remainder unitrust or a charitable gift annuity. All three have the same requirement: they must be “funded exclusively by qualified charitable contributions.”
