Julie Jason: Kids and finances: Can you be a positive influence?

If you are a parent or grandparent, how important is it to you to be a positive influence in the lives of young ones when it comes to personal finances?

Financial literacy experts tell us that Americans don’t have basic financial literacy skills. Is there something you can do with your children (or grandchildren) to help them learn sound financial decision-making?

It doesn’t take much to make a difference. The starting point can be as simple as reading a book together. There are several choices for children, even for those as young as 3.

“My First Money Book” by Reggie Nelson is a colorful 42-page guide for parents and children covering “saving, spending, sharing and investing.”

“Money Ninja” and “Investor Ninja,” both by Mary Nhin, are two titles whose goal is to raise financially savvy children. I can’t argue with that mission. Struggles considered include: “I wish I could buy the new game, but my mom won’t give me the money. And, I already spent my allowance on library fines.”

Or what about this exchange in “The Steady Road to a Million Dollars,” by Brad R. Biagi, about a real kid who started learning at age 5.

“Bradley, how much money is this?”

“$25, Daddy.”

“If you put this in your piggy bank and let it sit overnight, how much will it be tomorrow?”

“It will still be $25, Daddy.”

[And after a month?]

“It will still be $25 Daddy: It can’t change to another number in my piggy bank.”

If you read that dialogue, it easily leads to questions you and your child or grandchild can consider, leading to a greater understanding of saving and the use of funds. It can also lead to an allowance or earning money for doing chores.

Julie Jason: Conflicts of interest for a lawyer/executor

Conflicts of interest exist in just about any professional engagement. Sometimes, however, they are not that easy to spot, especially if there is a knowledge disparity between the buyer and the seller.

Think about it: Compare your knowledge of medicine to a seasoned physician’s knowledge.

Quoting JAMA, a medical journal, “Even when doctors think they are acting without bias, their judgments and actions may still be influenced by conflict of interest.” How? When financial benefits might come into play ( tinyurl.com/4td2uy5z).

The same applies to other professionals. What’s a potential conflict when it comes to estate planning? Serving as both the estate planning lawyer as well as a fiduciary (trustee or executor) is an example.

Addressing potential conflicts upfront and in writing before an engagement is the answer.

Take a minute to look at the recommended language provided by The American College of Trust and Estate Counsel (ACTEC). See “Form of a Letter Regarding the Appointment of the Lawyer as a Fiduciary” ( tinyurl.com/2p9xesd8):

Julie Jason: How are executors paid?

To continue our discussion of executors from last week, let’s talk about how executors are paid for what they do.

But, first, let’s review the executor’s job, as described by the New York City Bar (see tinyurl.com/2p8vhe6n):

• Locating and making an inventory of all your property and transferring it to the estate;

• Paying your bills and taxes;

• Collecting debts owed to the estate;

• Investing and managing your assets during the probate proceeding;

• Distributing your property to those who you chose to receive it at the end of the probate proceeding.

The executor continues until the job is done and the estate is officially closed by the probate court. “Estates may be closed when the executor has paid all debts, expenses and taxes... and has distributed all assets on hand,” according to the American Bar Association’s “Guidelines for Individual Executors & Trustees” (tinyurl.com/4tmfw4n2).

That can be a time-consuming process, depending on the size and complexity of the estate, and executors do get paid for their time and effort.

Some states set executor fees by statute. For example, New York’s “executor’s commission” is calculated based on the size of the probate estate using this formula, which is tied to “receiving and paying out” sums of money:

• First $100,000 is 5%;

• Next $200,000 is 4%;

• Next $700,000 is 3%;

• Next $4,000,000 is 2.5%;

• The remaining...
